Agreement for General Bookings
When a confirmed booking is made and accepted by the Ausrtalian Superyacht Training College (hereafter referred to as the 'College') a binding contract shall be deemed to subsist between both parties. No liability shall accrue to either the College or student if either is prevented from fulfilling any of their contractual obligations by any incidence of force majeure including acts of God, strikes, or any other event which can reasonably be beyond the control of either party. In the event of any dispute arising out of the terms of this contract, it shall be referred to a mutually acceptable arbiter whose decision shall be binding to both parties. It is understood that the student will indemnify the College for any non-insurable claims that may be made against it for damage or loss caused by the student whether wilful or through negligence.

HOW DO I BOOK?
  1. Read the conditions and legal disclaimer shown on this page.
  2. Send us an email by clicking “contact us” at the bottom of the page detailing your contact details, choice of course and preferred date, and whether you require assistance with transport and/or accommodation.
  3. We will contact you to confirm your choice and make payment arrangements. When you make a payment you agree that you have read and accept our conditions and legal disclaimer.
  4. We will email a confirmation and tax invoice.

PAYMENT
  1. Payment will normally be by Credit Card or Direct Deposit.
  2. A 50% deposit is due on registration with the balance due at least 14 days prior to the course start date.
  3. Full payment is required if registration is within 14 days of the course start date.

CANCELLATION
  1. The College reserves the right at its' discretion to transfer the course from one vessel to another and this action will in no way waive the terms and conditions stated herein. The College reserves the right to postpone or cancel a course should minimum numbers not be enrolled 14 days prior to the scheduled start date. In the event of the College having to postpone or cancel a course students will be offered alternative dates to complete the course. In the event of the College having to postpone or cancel a course without offering any acceptable alternative then the student shall be entitled to a full refund of monies paid and no further liability shall be incurred by the College.
  2. Cancellations made prior to 14 days before the course start date will incur a loss of deposit.
  3. There will be NO REFUNDS given for cancellations made less than 14 days prior to the course start date. Irrespective of the reason there will be NO REFUNDS if a student does not finish a course.
  4. A student may request to reschedule a course at any time with no financial penalty. In this case we will endeavour to comply however will not be held responsible if a suitable time cannot be confirmed.

WEATHER CONDITIONS

Whilst every effort will be made by the Instructor to give the students maximum time on the sea, weather conditions may be such that, in the opinion of the Instructor, the yacht or crew may be in danger and in such circumstances the vessel will remain in a place of safety. If the weather conditions are such that a prevention of the start or curtailment of a course occurs then no refunds will be given but alternative dates will be offered.

MEDICAL

The student agrees to advise the College in writing of any medical disability or illness which may adversely affect the ability to participate in the course that they have chosen. It shall be at the discretion of the College to refuse to accept a booking of a student where there is an unacceptable risk to the party and the College in doing so.

PRICING

Goods and Services Tax is included in all course prices. Prices are valid in Australian Dollars.

DISCLAIMER

The College shall not be held liable for death, personal injury, loss or damage to property howsoever arising and therefore by signing this booking form, you hereby release, to the full extent permitted by state, law and equity, The College, its' employees and agents from all actual and contingent liability in respect of such personal injury, death, loss or damage.
